Nursing home fined after rape inquiry

Aug. 8--DIXON -- Dixon Rehabilitation and Health Care Center was fined $25,000 after investigators say the nursing home failed to adequately supervise a resident who raped another resident.

The Illinois Department of Public Health issued the fine earlier this year following an investigation of an incident on Thanksgiving where a resident raped another resident with his fingers, according to the IDPH report.

"Based on the interview and record review the facility failed to supervise a male resident with known sexual aggression to prevent resident from having access to female residents on the dementia unit," the report said.

According to the investigation:

The resident was admitted to the facility, 800 Division St., in June 2018 with diagnoses including frontal lobe dementia, delusional disorders, generalized anxiety disorder, major depressive disorder, and restlessness and agitation.

He was transferred to a psychiatric hospital after an altercation with another resident and was readmitted to Dixon Rehab in September with a care plan that included monitoring certain behaviors and checking on him every 15 minutes.

His behavior began to grow more aggressive sexually including making inappropriate comments to women staff members and guests of the nursing home, and he expressed desire to kiss and have sex with other residents, including asking a nurse "I want her, can I have her?" about one of the residents.

On Oct. 27, he was placed on increased behavioral monitoring after sitting on a couch next to a resident and touching her inappropriately across her chest, down her leg and poking her hip.

On Nov. 22, two certified nursing assistants were moving a chair to another room when the resident was pacing in the hallway. One of the CNAs returned, didn't see him in the hallway and heard "that hurts" coming from another resident's room, where he was found standing over her pulling a blanket back over her waist.

When asked what he was doing, he told the CNA in a vulgar comment that he was penetrating the resident with his fingers. He was discharged from the facility shortly after.

Officials at the nursing home could not be reached for comment.
